This PC Meeting will be primarily a work session to discuss and plan for the necessary land use code and comprehensive plan updates. The objective of this meeting is to create a roadmap to compliance and updates while setting Planning Commission Goals for the 2023-24 Fiscal Year.

A Planning Commission Chair and Vice Chair will be elected to serve the remainder of 2023 per land use code Section 3.050: Presiding Officers. At its first meeting of each calendar year, the Commission shall elect a chairperson and vice-chairperson to serve for that year.

TYPE III CONDITIONAL USE PERMIT AND DEVELOPMENT PERMIT APPLICATION  

NOTICE IS HEREBY GIVEN THAT a public hearing will be held by the Rivergrove Planning Commission at or shortly after 7:00 PM on Tuesday, June 27, 2023, via Zoom (see invitation on following page) to consider the following:  

Hearing Request: An appeal of the Planning Commission decision and approval of a Type III Conditional Use Permit and Development Permit to demolish an existing single-family home and construct a new dwelling on the property. A variance is requested to Section V, G. (3) of Ord. 70-2001 requiring that any excavation below the 10-year flood elevation of the property shall not count toward compensation for fill.

The public hearing on this matter will be conducted pursuant to the rules of procedure adopted by the City Council. Oral and written testimony in favor of or in opposition to the request will be received during the hearing. Written comments may be submitted prior to the hearing by mailing to Lisa Merlo Flores City Manager/Recorder, City of Rivergrove P.O. Box 1104, Lake Oswego, OR 97035 or at manager@cityofrivergrove.com to be received no later than 3 P.M. June 27, 2023.  The decision to approve or deny the application will be based on compliance with the following ordinance criteria:

❑  Rivergrove Land Development Ordinance (RLDO) Article 4 Sec. 4.010-4.110 Review Procedures; Article 5 Sec. 5.010-5.100 Residential Zone, Sec. 5.020 Flood Hazard District, Article 6 Sec. 6.300-6.340

❑  Ordinance 70-2001 Rivergrove Flood Ordinance including Section VIII Variance

Copies of the application information can be obtained at cost and are available for review by contacting the City Manager/Recorder, at 503-639-6919. Any questions regarding the application should also be addressed to the City Manager/Recorder. A staff report will be available for inspection on or about April 11, 2023 (contact the City Manager/Recorder to see the report or obtain a copy provided at cost).

Issues regarding compliance with pertinent code standards may provide the basis for an appeal to the City Council and shall be raised and submitted before the record is closed. Issues must be raised with sufficient specificity to enable a response to the issue. Failure to raise an issue in person or by letter, or failure to provide sufficient specificity to afford the decision-maker an opportunity to respond to the issue precludes appeal to City Council on that issue.

In addition, failure to raise constitutional or other issues relating to proposed conditions of approval, with sufficient specificity to allow the Planning Commission to respond to the issue, precludes an action for damages in circuit court.

The Planning Commission shall review the application under a Type III procedure and make a decision according to the applicable criteria specified above. This hearing may be continued without additional published notices. All interested persons are invited to attend and be heard.

CITY COUNCIL BUDGET MEETING 

Re: BUDGET PROPOSAL AND ADOPTION

Notice to the residents of Rivergrove regarding two upcoming public meetings of the Rivergrove City Council, Washington/Clackamas Counties, State of Oregon, on the Budget for the 2023-24 fiscal year will be held via Zoom. 

The first meeting will take place on Thursday June 22 at 7pm. The second meeting will be held on Thursday June 29 at 7pm.  A third meeting on Friday June 30 at 7pm will be held if needed for adoption of the 2023-24 Budget Resolution.  Login and telephone number to attend the meeting virtually will be posted on the City of Rivergrove website and parks prior to the meetings.

A proposed budget for fiscal year 2023-24 has been approved by the Budget Advisory Committee and is now passed to the City Council for discussion and adoption.  During these upcoming meetings, revisions may be made as needed to meet the fiscal obligations and project goals of the City of Rivergrove.  

The public is invited to submit written testimony to the City Manager for Council review no later than June 22 at 3pm via email.  The public is also invited to provide verbal testimony to the City Council at the June 22 meeting.  A copy of the budget document may be inspected or obtained on or about June 22, 2023 on the City’s website: https://www.cityofrivergrove.com.   Budget documents will change as the Council deems necessary.  The Adopted Budget Resolution will be available after submission to the State of Oregon on July 1, 2023.
