A continuation of the work session which began on July 17, 2023 to further discuss and plan for the necessary land use code and comprehensive plan updates. 

PRESENTATION: Metro Representative will discuss grants available for Small City Planning Updates.

Citizen Michael Salch regarding the Status of the Rivergrove Land Use Ordinances with DLCD (the Department of Land Conservation and Development) and the possible pathway forward

TBD: Agent from LCDC (Land-Use Conservation and Development Commission) to advise on Land Use Codes and Comprehensive Plan Updates.

AGENDA

This PC Meeting will be primarily a work session to discuss and plan for the necessary land use code and comprehensive plan updates. The objective of this meeting is to create a roadmap to compliance and updates while setting Planning Commission Goals for the 2023-24 Fiscal Year.

A Planning Commission Chair and Vice Chair will be elected to serve the remainder of 2023 per land use code Section 3.050: Presiding Officers. At its first meeting of each calendar year, the Commission shall elect a chairperson and vice-chairperson to serve for that year.

Proposed New Code~A Look at the Similarities, Differences

Planner Kirk Fatland will introduce the Planning Commission to the proposed new Land Use Code, based on the Oregon Small Cities Model Code. He will describe how this code differs from our existing ordinances and how it is similar.

Although this is not a public hearing, citizens are invited to listen in for their own knowledge. Both the current ordinances (Ordinance 54-89) and the proposed new code can be found on our city website (www.cityofrivergrove.org) under the heading Ordinances. The City of Rivergrove has determined that adoption of the regulations may affect the permissible uses of your property, and other properties in the affected zone and may change the value of your property.

The Rivergrove Planning Commission will hold a public hearing on Monday, May 17, 2021, at 7:00 PM to consider proposed changes to the Rivergrove Development Code. A new development code is proposed based on the Oregon Model Code for Small Cities with new development standards, definitions, and procedures for land use planning and decision-making.

The Rivergrove City Council may consider the Planning Commission's recommendation on the adoption of the development code changes during a public hearing on Monday, June 14, 2021, at 7:00 PM.

PROPOSAL:

The City of Rivergrove is proposing to adopt a new development code based on the Oregon Model Code for Small Cities that will include new development standards, definitions, and procedures. Copies of all documents can be purchased at cost.

ABOUT THIS NOTICE:

In 1998, Oregon’s voters passed a law known as Ballot Measure 56. It requires that notices like this be mailed to landowners when a change in land use laws might limit the use of their property. The law requires the City of Rivergrove to use the above wording in such notices, even though that wording may not describe the likely effects of the change in land-use laws very well. The measure also requires the notices to say that Rivergrove has determined that the proposed land-use changes “may change the permissible uses of your property, and other properties in the affected area, and may change the value of your property.” However, the City of Rivergrove has not determined how these amendments might affect the value of your property, if at all.

REVIEW CRITERIA:

Legislative actions including amendments to the Rivergrove Land Development Ordinance (RLD) must follow a Type IV procedure subject to the requirements of Sections 6.227 to 6.230 of the RLDO. Following the public hearing, the Planning Commission shall make a recommendation to the City Council on the amendment. That action may include recommending approval of the amendment as presented or as modified by the Commission, recommending denial of the amendment as presented, or a continuation of the amendment to the next Planning Commission meeting.

Pursuant to ORS 197.763, failure to raise an issue by the close of the record, in person or by letter, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue precludes appeal based on that issue.

Rivergrove Town Hall Meeting Concerning the Boat Ramp

The City Council will hold a Town Hall meeting to discuss recent comments about the Boat Ramp. However, the meeting will not cover any discussion about the closure of the ramp, because that is not under consideration. Councilor Dave Pierce has submitted a report which can be found on our website, along with resident and non-resident comments.
